1. Business identity and scope

This website is operated by Cool Gas Depot LLC, doing business as Cool Gas Depot, at 1061 Classic Rd #100, Apex, NC 27539, United States (“Cool Gas Depot,” “we,” “us,” or “our”). These terms apply to U.S. website use and retail transactions unless a signed written agreement expressly states otherwise.

2. Eligibility and legal compliance

You must be at least 18 years old, have legal capacity to contract, and use the website only for lawful purposes. You are responsible for determining and satisfying all federal, state, local, employer, licensing, certification, handling, storage, transport, and end-use requirements.

You represent that credentials and information submitted are accurate, current, yours or lawfully provided on behalf of an eligible employer, and not altered or borrowed. You may not purchase for an ineligible person or evade a restriction through a third party, reshipper, false destination, or split transaction.

3. Accounts and communications

You are responsible for account information, password confidentiality, and activity under your credentials. Notify us promptly of unauthorized use. We may suspend an account to protect customers, the website, or compliance processes.

You consent to receive transactional emails, calls, or messages reasonably related to verification, payment, fraud review, fulfillment, delivery, returns, recalls, safety, and account service. Marketing communications are governed by your preferences and applicable law.

4. Product information and compatibility

We work to present accurate names, weights, images, descriptions, availability, and prices, but errors can occur. Packaging, labels, shade, or manufacturer details may change without altering the specified product. Website images are illustrative and do not replace the cylinder label or SDS.

You must confirm the exact refrigerant, cylinder size, system nameplate, equipment approval, application, pressure class, lubricant, fittings, and service procedure with a qualified professional before ordering or use. We do not authorize refrigerant mixing, unapproved substitution, or a retrofit.

5. Orders and acceptance

Your order is an offer to purchase. Automated acknowledgement is not acceptance. We may request information, limit quantity, correct an error, reject suspected fraud, or decline an order based on inventory, payment, pricing error, verification, destination, carrier, safety, or legal requirements.

A contract is accepted only when we confirm fulfillment or ship the applicable item. If we cancel after capturing payment, we will refund the canceled amount to the original payment method.

6. Prices, taxes, and payment

Prices are in U.S. dollars and can change before purchase. Applicable sales tax and any clearly disclosed charge are shown at checkout. Standard shipping is free for products eligible for delivery under our Shipping Policy.

Payments are processed through Stripe and participating networks. Available methods can include Visa, Mastercard, American Express, Discover, Apple Pay, and Google Pay. You authorize us and our providers to verify, authorize, capture, refund, and, when appropriate, update or correct the transaction.

Promotions cannot be combined unless stated. We may correct an obvious pricing, tax, availability, or description error and offer cancellation or purchase at the corrected price before fulfillment.

7. Shipping and delivery

Orders are subject to our Shipping Policy. Our processing target is 1–2 business days after all reviews are complete, and typical transit is 3–7 business days after dispatch. These are estimates, not guarantees.

You must provide a lawful, complete, and deliverable U.S. address. Hazardous-material rules can limit carrier, service level, destination, rerouting, and returns. Responsibility for loss is allocated under applicable law, and no term limits a non-waivable consumer right.

8. Cancellations, returns, and refunds

You may request cancellation before shipment, but we cannot guarantee a stop after processing begins. Approved returns are governed by our Returns & Refund Policy, including the 30-day request window, unopened and sealed condition, written authorization, compliant carrier instructions, and any disclosed 20% restocking fee for a voluntary standard return.

No restocking fee applies to a confirmed wrong, defective, or transit-damaged item. We cover authorized return shipping for an eligible return. Never ship a refrigerant cylinder back without our written instructions.

9. Safety, installation, and environmental responsibility

You agree to follow the product label, SDS, equipment instructions, EPA requirements, workplace rules, and applicable hazardous-material, fire, building, environmental, transport, and disposal law. Refrigerants and pressurized cylinders may cause serious harm if misidentified, heated, punctured, released, mixed, transported, stored, or used improperly.

Installation, charging, recovery, repair, and retrofit decisions are the responsibility of the purchaser and qualified service professional. See our Safety Information.

10. Prohibited conduct

You may not:

• violate law, impersonate another person, submit false credentials, or interfere with eligibility review;
• access accounts or systems without authorization, introduce malicious code, scrape excessively, or disrupt service;
• copy, resell, frame, or exploit website content except as law permits;
• use products for unlawful venting, mixing, relabeling, counterfeiting, unsafe handling, or unauthorized resale; or
• circumvent product, quantity, payment, geographic, certification, or carrier restrictions.

11. Intellectual property and reviews

The website design, text, graphics, logo, code, and compilation are owned by or licensed to Cool Gas Depot and protected by applicable law. Product and third-party marks belong to their owners. No license is granted except the limited right to use the website for its intended purpose.

If you submit a review, photo, or other public content, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, and display it for store operation and promotion. You represent that you have the rights to submit it and that it is accurate, lawful, and not confidential. We may moderate content but are not required to publish it.

12. Third-party services

Stripe, carriers, social platforms, analytics tools, and linked websites are operated by independent parties under their own terms. We are not responsible for an independent third party’s service, content, outage, privacy, or conduct, except to the extent applicable law makes us responsible.

13. Disclaimers

To the maximum extent permitted by law, the website and general informational content are provided “as is” and “as available.” We disclaim implied warranties concerning the website, including merchantability, fitness for a particular purpose, title, and non-infringement. Product warranties, if any, are those expressly provided in writing by us or the manufacturer.

We do not warrant uninterrupted access, perfect accuracy, universal product compatibility, or a specific result. Nothing here excludes warranties or remedies that cannot lawfully be disclaimed.

14. Limitation of liability

To the maximum extent permitted by law, Cool Gas Depot LLC and its owners, personnel, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, business, data, or goodwill, arising from website use or a product.

To the maximum extent permitted by law, our aggregate liability for a claim relating to an order will not exceed the amount you paid us for the product giving rise to the claim. These limits do not apply where prohibited or to liability that cannot legally be limited.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cool Gas Depot LLC and its personnel from third-party claims, losses, and reasonable costs arising from your unlawful use, false purchaser documentation, unauthorized resale, violation of these terms, or infringement of another person’s rights. This does not require a consumer to indemnify us for our own unlawful conduct or negligence where prohibited.

16. Governing law and disputes

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where mandatory law requires otherwise. Any court proceeding must be brought in a state or federal court having jurisdiction in North Carolina, and each party consents to that court’s jurisdiction, subject to non-waivable rights.

Before filing a claim, contact support@coolgasdepot.shop with the order number and a concise description so the parties can attempt a good-faith resolution.

17. General terms

If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a business transfer. Headings are for convenience. These terms and incorporated policies are the entire online-store agreement concerning their subject.

18. Changes and contact

We may update these terms by posting a revised version with a new date. Changes apply prospectively unless law permits otherwise. Continued website use after the effective date means acceptance of the updated terms.
